As part of its legitimate business, Carr-Lyons Search & Selection collects and processes personal data relating to job applicants. Carr-Lyons Search & Selection is committed to being transparent about how it collects and uses that data and to meeting its data protection obligations.

 

What information does Carr-Lyons Search & Selection collect about you?

Carr-Lyons Search & Selection collects a range of information about you.  This includes:

 

  • Your name, address and contact details, including email address and telephone number
  • Details of your qualifications, skills, experience and employment history
  • Information about your current level of remuneration, including benefit entitlements
  • Whether or not you have a disability for which Carr-Lyons Search & Selection needs to make reasonable adjustments during the recruitment process
  • Information about your entitlement to work in the UK

 

Carr-Lyons Search & Selection may collect this information in a variety of ways.  For example, data might be contained in application forms, CVs or resumes, obtained from your passport or other identity documents, or collected through interviews or other forms of assessment including online tests or assessments.

 

Carr-Lyons Search & Selection may process special categories of data, such as information about ethnic origin, sexual orientation or religion or belief, to monitor recruitment statistics.  It may also collect information about whether or not applicants are disabled to make any necessary reasonable adjustments for candidates who have a disability.

 

Carr-Lyons Search & Selection may also collect personal data about you from third parties, such as references supplied by former employers, information from employment background check providers and information from criminal records checks.  Carr-Lyons Search & Selection will seek information from third parties only once a job offer to you has been made by a prospective employer and will inform you that it is doing so.

 

Data will be stored in a range of different places, including on your application record, in Carr-Lyons Search & Selection recruitment management systems and on other IT systems (including email).

 

Why does Carr-Lyons Search & Selection process your personal data?

Carr-Lyons Search & Selection needs to process data to take steps, at your request, to match you with suitable potential employers. This is part of Carr-Lyons Search & Selection Legitimate Business Interest as a candidate search and selection business.   

 

In some cases, Carr-Lyons Search & Selection needs to process personal data to ensure that it is complying with its legal obligations.  For example, it is required to check a successful candidate’s eligibility to work in the UK before any potential employment starts.

For some prospective roles, Carr-Lyons Search & Selection is obliged to seek information about criminal convictions and offences.   Where Carr-Lyons Search & Selection seeks this information, it does so because it is necessary for it to carry out its obligations and exercise specific rights in relation to prospective employment.

 

Carr-Lyons Search & Selection will retain your personal data on file for a minimum of 5 years after last contact in case there are future employment opportunities for which you may be suited. 

 

Who has access to your data?

Your information may be shared internally for the purposes of the recruitment exercise.  This includes with members of the Carr-Lyons Search & Selection recruitment team, interviewers involved in the recruitment process, and IT staff if access to the data is necessary for the performance of their own roles.

 

Carr-Lyons Search & Selection will be required to share your data with third parties in order to match you with prospective employers and this includes potential managers in the prospective employer with a vacancy however in these circumstances your consent will be gained and recorded prior to sending any personal information. 

 

Carr-Lyons Search & Selection will then share your data with former employers to obtain references for you if required by the prospective employer, employment background check providers to obtain necessary background checks and if necessary the Disclosure and Barring Service to obtain necessary criminal records checks if required for the role.

 

Carr-Lyons Search & Selection will not transfer your data outside the European Economic Area.

 

How does Carr-Lyons Search & Selection protect your data?

Carr-Lyons Search & Selection takes the security of your data seriously.  It has internal policies and controls in place to ensure that your data is not lost, accidentally destroyed, misused or disclosed, and is not accessed except by our employees in the proper performance of their duties. 

 

For how long does Carr-Lyons Search & Selection keep your data?

Carr-Lyons Search & Selection will hold your data on file to match with prospective employers for 5 Years after the date you last updated your details or had contact.   At the end of that period or once you withdraw your consent your data is deleted or destroyed.

 

If you are successful in gaining employment through Carr-Lyons Search & Selection, copies of your personal data gathered during the recruitment process will be transferred to your new Employer’s personnel/HR team.  Your data will continue to be held by Carr-Lyons Search & Selection for 5 years after your appointment in the event you may continue to seek further employment.   You can exercise your right for removal of your personal data by contacting Sean Carr DPO@carrlyons.com at Carr-Lyons Search & Selection.

 

Your rights

As a data subject, you have a number of rights.  You can:

  • Access and obtain a copy of your data on request
  • Require Carr-Lyons Search & Selection to change incorrect or incomplete data
  • Require Carr-Lyons Search & Selection to delete or stop processing your data, for example where the data is no longer necessary for the purposes of processing
  • Object to the processing of your data where Carr-Lyons Search & Selection is relying on its legitimate interests as the legal ground for processing

What if you do not provide personal data?

You are under no statutory or contractual obligation to provide data to Carr-Lyons Search & Selection during the recruitment process.  However, if you do not provide the information, Carr-Lyons Search & Selection may not be able to process your matching to prospective employers properly or at all.

Carr-Lyons Search & Selection employment decisions are not based solely on automated decision-taking.
